These Terms of Service ("Terms") govern your use of the Magneety platform at app.magneety.com, the marketing site at magneety.com, and any related services (together, the "Service"). By creating an account or using the Service you agree to these Terms.
The Service is operated by Magneety EU Ltd, registered in Bulgaria (UIC 208453175, VAT BG208453175), 5 Ekzarh Yosif I Str., 2nd floor, Office 1, 9300 Dobrich, Bulgaria.
Magneety helps small and mid-sized businesses plan, schedule, and analyze marketing across connected ad and social platforms. Features include AI-generated content, content calendaring, ad campaign creation and management, performance reporting, branded reports, a unified inbox, and AI-powered insights.
Until Magneety enters general availability, the Service is provided as a private beta available by invitation only. During the beta period the Service may evolve, features may change without notice, and limited downtime should be expected. Beta participants get continued access at the same plan price ("beta-locked pricing") for the lifetime of an active subscription.
You may not use the Service to:
When you connect Meta, Google, LinkedIn, TikTok, X, Klaviyo, GA4, Shopify, or other accounts, you authorize Magneety to act on your behalf within the scope of permissions you granted on each platform. You remain bound by those platforms' terms of service. We are not responsible for changes to their APIs, fee structures, account suspensions, or other actions caused by their policies.
When using Meta features through Magneety you also agree to comply with the Meta Platform Terms and the Meta Community Standards. When using Google Ads features you agree to comply with the Google Ads policies. We may suspend or remove access to platform features if you breach those policies.
You retain ownership of all content you upload, create, or generate using Magneety ("Your Content"). You grant us a non-exclusive, worldwide, royalty-free license to host, store, process, transmit, and display Your Content solely as necessary to deliver the Service to you. AI-generated content is yours to use; some upstream AI providers' terms may apply for highly specific use cases (e.g. trademark filings).
You represent that you have all rights necessary to upload, publish, and use Your Content - including any rights from people depicted in images you upload, music in videos, or copyrighted material. You are solely responsible for obtaining permissions and paying any royalties.
We aim for 99.5% monthly uptime but do not guarantee it. Scheduled maintenance, third-party outages (e.g. Meta, Google API downtime), force majeure events, and emergency security work may cause downtime.
AI-generated text, images, and recommendations are produced by third-party models (Anthropic, Replicate, FAL.ai). They may occasionally produce inaccurate, offensive, or misleading output. You are responsible for reviewing all AI-generated content before publishing or using it commercially. Magneety does not warrant the accuracy or fitness for purpose of AI output.
The Service is provided "as is" and "as available" without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or any guarantee of marketing outcomes (revenue, conversions, follower growth). AI-generated recommendations are advisory and require human judgment.
To the maximum extent permitted by law, our aggregate liability arising out of or relating to these Terms or the Service is capped at the fees you paid to Magneety in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, incidental, consequential, special, or exemplary damages, including lost profits, lost data, business interruption, or loss of goodwill.
You agree to defend, indemnify, and hold harmless Magneety and its officers, employees, and agents from any third-party claim, loss, or liability arising out of (a) Your Content, (b) your violation of these Terms, (c) your violation of a third party's rights or applicable law, or (d) your use of the Service in breach of a connected platform's terms.
You may terminate your subscription at any time via Settings → Billing → Cancel. We may terminate or suspend your account for breach of these Terms with reasonable notice, or immediately for serious abuse or risk to other users. On termination your data is retained for 30 days then permanently deleted; you may request immediate deletion before the 30-day window.
For business customers processing personal data of EU/EEA or UK residents through Magneety, our Data Processing Agreement (DPA) is available on request at info@magneety.com. Signing the DPA is a precondition for using Magneety to process personal data on your customers' or contacts' behalf.
These Terms are governed by the laws of Bulgaria, excluding its conflict-of-laws rules. Disputes are subject to the exclusive jurisdiction of the courts of Dobrich, Bulgaria, except where mandatory consumer protection law in your country of residence requires otherwise. EU consumers may also access the European Commission's online dispute resolution platform at ec.europa.eu/consumers/odr.
We may update these Terms from time to time. Material changes will be announced via email at least 30 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms. The "Last updated" date at the top of this page reflects the most recent revision.
